Official Rules of the Giveaway

Version in effect:

1. Identification of the Organizer

Tactta (hereinafter, “Tactta” or “the Organizer”), with website domain tactta.com and contact address hola@tactta.com, organizes this promotional giveaway for advertising purposes, in accordance with Article 2.2 of Spanish Law 13/2011, of May 27, on the Regulation of Gambling.

2. Territorial and Temporal Scope

  • Territorial scope: The giveaway is limited to the territory of Spain (mainland Spain, the Balearic Islands, the Canary Islands, Ceuta and Melilla).
  • Start date: May 1, 2026 at 00:00 (CEST).
  • End date: May 31, 2026 at 23:59 (CEST).
  • Drawing date: June 3, 2026.

3. Eligibility Requirements

To enter, participants must meet the following requirements:

  1. Be a natural person over 18 years of age.
  2. Be a legal resident of Spain.
  3. Not be an employee, collaborator, supplier or immediate family member of the Organizer.
  4. Expressly accept these official rules and the privacy policy.

Minors and legally incapacitated persons are expressly excluded. The Organizer reserves the right to verify the winner’s age by means of a national identity document (DNI) or equivalent document.

4. Entry Mechanics

Participation is free of charge and entails no obligation to purchase or make any payment. To enter, the user must:

  1. Visit the giveaway page at tactta.com/sorteo.
  2. Provide a valid email address.
  3. Expressly accept the official rules and the privacy policy.
  4. Confirm that they are over 18 years of age.

Optionally, participants may earn additional entries by sharing the giveaway with friends through the personalized link generated for them. Each friend who registers through said link will grant one extra entry to the referrer.

Each person may enter only once, using their own email address. Multiple email addresses from the same person will not be accepted.

5. Prizes

The Organizer will award by random drawing a total of 3 prizes, each consisting of:

  • 1 (one) Tactta 10-Piece BDSM Kit (estimated market value: €29.99).

Total value of the prizes: €89.97. As each prize has a unit value below €300, no withholding or payment on account of Spanish Personal Income Tax (IRPF) applies, in accordance with the regulations in force (Article 75.3.f of the Spanish Personal Income Tax Regulations).

The Organizer shall bear the 10% tax on random combinations levied on the total value of the prizes, pursuant to Article 48 of Law 13/2011.

Prizes are personal and non-transferable, and may not be exchanged for cash or for any other product.

6. Winner Selection

The drawing will be conducted using an automated random selection tool (RandomPicker or similar), which will issue a certificate attesting to the validity of the process. The following will be selected:

  • 3 main winners.
  • 3 alternates, who will receive the prize in the event that any of the main winners fails to meet the requirements or does not respond within the established deadline.

7. Notification and Acceptance of the Prize

The Organizer will notify the winner by email at the address provided upon entry, within a maximum of 48 hours from the date of the drawing.

The winner must accept the prize within 72 hours of notification, providing:

  • Full name.
  • A copy of their national identity document (DNI) or equivalent document (to verify legal age).
  • A complete postal address for delivery of the prize.

If the winner does not respond within the stated period or does not meet the requirements, they will forfeit their right to the prize and the corresponding alternate will be contacted.

8. Prize Delivery

The prize will be shipped to the address provided by the winner within a maximum of 30 calendar days from acceptance of the prize. The shipment will be made in plain, discreet packaging, with no branding or indication of the contents, and shipping costs will be borne by the Organizer.

9. Personal Data Protection

In compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), participants are informed of the following:

  • Data controller: Tactta — hola@tactta.com
  • Purpose: Management of the giveaway, communication with participants and notification of the winner.
  • Legal basis: The participant’s express consent upon accepting these rules.
  • Retention: Data will be retained for the duration of the giveaway and for an additional 6 months for the resolution of any claims. After that period, the data will be deleted unless the user has given separate consent to receive commercial communications.
  • Disclosures: Data will not be disclosed to third parties except where required by law.
  • Rights: Participants may exercise their rights of access, rectification, erasure, objection, restriction and portability by sending an email to hola@tactta.com. They may also file a complaint with the Spanish Data Protection Agency (aepd.es).

Consent to receive commercial communications is optional and separate. It is not necessary to accept such communications in order to enter the giveaway.

10. Image Rights

The winner authorizes the Organizer to publish their name (optionally, first name and initial of surname only) and a photo of the prize handover on the Organizer’s social media and own channels, exclusively for purposes of transparency of the giveaway. This authorization may be revoked at any time.

11. Modification, Cancellation and Disqualification

The Organizer reserves the right to modify, postpone or cancel the giveaway in the event of force majeure, serious technical problems or any other circumstance affecting its normal course, duly informing the participants thereof.

The Organizer may automatically disqualify any participant who:

  • Breaches any of these rules.
  • Uses fraudulent means to enter (multiple accounts, fake email addresses, bots, etc.).
  • Provides false or inaccurate personal data.

12. Relationship with Third-Party Platforms

This giveaway is not sponsored, endorsed, administered by, or associated with Meta (Instagram, Facebook), X (Twitter), Reddit or any other social media platform. The information provided by participants is supplied exclusively to Tactta.

13. Taxation

As the unit value of each prize is below €300, winners are not subject to withholding or payment on account of Spanish Personal Income Tax (IRPF). However, prizes must be reported as a capital gain in the winner’s annual Personal Income Tax (IRPF) return, in accordance with Spanish tax regulations.

The Organizer bears the tax on random combinations (10% of the total value of the prizes).

14. Acceptance of the Rules

Participation in the giveaway implies full and unconditional acceptance of these official rules and of the Organizer’s privacy policy.

15. Governing Law and Jurisdiction

These rules are governed by Spanish law. Any dispute arising from the interpretation or performance of these rules shall be submitted to the courts and tribunals of the consumer’s place of residence.
